Last 19 August 2021, the Mines and Geosciences Bureau Region X spearheaded the conduct of biennial Multi-Stakeholders Review Team (MST) review and evaluation to determine compliance with the terms and conditions of the Industrial Sand and Gravel (ISAG) Permit, the applicable provisions of the Mining Act of 1995, and other applicable mining and environmental laws, rules and regulations.
The MST was created pursuant to Executed Order No. 79 series of 2012 entitled, “Institutionalizing and Implementing Reforms in the Philippine Mining Sector Providing Policies and Guidelines to Ensure Environmental Protection and Responsible Mining in the Utilization of Mineral Resources” and MGB Memorandum Circular No. 2013-09, enumerating the nine agencies involved namely; DENR, DOLE, DOST, DA, DAR, DSWD DAR, NCIP, and LGU concerned.
Out of the six (6) ISAG Permits in Region 10, three (3) were reviewed and evaluated for the month of August, while the remaining permits were scheduled on the succeeding months. These were the respective permits of Oro NQA Enterprises, Ferdinand E. Dulatre and Caesar R. Casino with permit areas located at Tagoloan, Medina and Gingoog City, respectively, all located in the province of Misamis Oriental.
One of the issues raised was the immediate establishment of the Final Mine Rehabilitation and Decommissioning Fund which will be used for the implementation of final mine rehabilitation and/or decommissioning plan in case a permit holder will no longer renew its permit or stop its operation. The permit holders then committed to immediately established the said fund in any government depositing banks. Further, Installation of the Social Development and Management Plan (SDMP) Bulletin Boards were also recommended by the MST and MGB monitoring team so that the public especially the affected communities are aware of the programs, projects and activities of SDMP.
Overall result of the review and evaluation showed that three ISAG Permit Holders were compliant to the terms and conditions of their permits during the review period.
