The review of the performance of existing mining operations is mandated under Section 6 of DAO 2012-07, the Implementing Rules and Regulations of E.O 79 signed by President Aquino last July 6, 2012, A law instituting Reforms in the Philippine Mining Sector. The said review will determine the compliance of the mining company with the environmental standards, laws, rules and regulations imposed and to rationalize the management and utilization of minerals towards sustainable development.
The said review and evaluation will be based on guidelines and parameters set forth on the specific mining contract, agreement or concession and in other pertinent or applicable laws, rules such as the Philippine Mining Act of 1995 and the Labor Code. Result will be submitted to the Minerals Industry Coordinating Council (NICC) for further evaluation.
Appropriate action will be immediately taken by the Government agency (cies) concerned
Against proven violators based on the findings and recommendations of the review.
